Sämtliche Aktivitäten in diesem Projekt werden unter Berücksichtigung einer "Anti-Trust Caution" geführt. Diese Klausel lautet wie folgt:

GS1 meetings prohibit all discussion of pricing, “fair” profit levels, pricing procedures, allocation of markets, sales controls or standards development which could be deemed an unfair trade practice.
GS1 has been organised as a not for profit trade association. Trade associations are subject to strict scrutiny under antitrust and fair competition laws because trade associations consist of businesses and organisations which compete with each other in a given market place. Nevertheless, US- courts have frequently held that trade associations promote commerce and benefits for consumers when their resources are focused on a public good. The development of GS1 standards is proven to be beneficial to both the public and private sectors. As well, GS1 has been vigilant to avoid areas or issues which could be viewed as anti-competitive or could violate antitrust laws.
